Uber-Nanny State – You Tired yet?

HB 1436, sponsored by Delegate Swain, requires all “retail service station dealers” to maintain at least one operational video camera, record the activity, and retain the activity.

(A) EACH RETAIL SERVICE STATION DEALER SHALL:

(1) MAINTAIN AT LEAST ONE OPERATIONAL VIDEO CAMERA ON THE EXTERIOR PREMISES OF THE SERVICE STATION FOR THE PURPOSE OF RECORDING ILLEGAL ACTIVITY; AND
(2) PRESERVE THE RECORDINGS MADE BY THE VIDEO CAMERA FOR AT LEAST 45 CALENDAR DAYS.

(B) A RETAIL SERVICE STATION DEALER WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $500.
